The ruse was discovered when Carr took Brand's phone, called one of the numbers, and an audience member answered. Chico also appeared via text, responding to Jack Whitehall.

Facts: On the night of June 11, 2005, plaintiff Jordan VanDusen, 23, a computer consultant and musician, was at a party at Longhorn Landing Apartments, an Austin apartment complex managed by Aspen Square Management Austin. VanDusen was a former resident of the complex, which caters to college students. He and other partygoers were drinking. At around 2 a.m., VanDusen and some friends entered one of the complex's two swimming pool areas, which were open 24 hours a day, seven days a week. VanDusen attempted a shallow "racing dive" into the pool, but the water level was 18 inches low, resulting in a steeper angle of entry. He hit his head on the bottom and broke his neck. He is paralyzed. When filled to normal level, the pool was between 3 feet, 6 inches deep and 4 feet, 6 inches deep. It was low that night because of a pool equipment problem. The complex had added water to the pool on June 10. At about 10 p.m. on June 11, security guard Amanda Walker came on duty and noticed that the water level was low. The apartment manager was still on site at this time. At about 1:25 a.m., Walker and another guard walked by the pool again and noted that it was low, and alerted a supervisor. The supervisor called all emergency contacts for the management company, and according to the plaintiff, no one responded. Several Aspen Square employees lived at the complex. The property owner was Longhorn Bentley. VanDusen sued Aspen Square and Longhorn Bentley for premises liability, arguing that, by common law and statute, the pool should have been closed because of the water level. VanDusen had been at the pool more than a hundred times and safely performed many dives there, as had many others, including employees of the complex. VanDusen acknowledged a momentary lapse in judgment, that he should not have dived into the pool that night, and that he regrets not noticing the water level was low before diving. Aspen Square Management, which was operating 80 properties nationwide, had no written risk management policy or written safety policies for its pools, its most dangerous amenity. According to the plaintiff Longhorn Landing allowed and encourage drinking in and around the pool, and its pool safety man was unaware of applicable laws and codes. VanDusen also argued that the complex's local emergency call system and personnel were inadequate and that, the weekend before the incident, an on-call worker ignored three emergency calls. The security guards did not have authority to use the locks that were restring on the gates or the "pool closed" signs that were in a nearby shed, the plaintiff argued. According to the plaintiff, no one employed by the complex knew of the incident, and the pool remained open until Monday, June 13. Plaintiffs counsel said they argued for 75% fault on defendants. Defense counsel said Plaintiff's counsel argued for 80 to 90 percent fault on defendants. The defendants denied the allegations and argued that Jordan was at fault. They noted that, about 45 minutes after the incident, Jordan's blood alcohol level was .09 and that he was aware of the numerous, conspicuous "no diving" signs around the pool. Also, according to the defense, an employee did respond to a 1:25 a.m. emergency page, though not till after VanDusen's injury. Plaintiff's counsel said the defendants were never able to identify the employee. The defendants were treated as a single entity (Aspen) in the jury charge. The jury questions were: 1. Whether VanDusen was negligent; 2. Whether Aspen was negligent per se for failing to maintain the water at the required level, failing to maintain pool equipment as required, failing to provide the required lighting, or failing to close the pool if required; 3. Whether Aspen was otherwise negligent; 4A. Comparative responsibility between Aspen for negligence per se only and VanDusen; 4B. Comparative responsibility between Aspen for other negligence only and VanDusen; 5. Damages

avoid these products. worst i have felt after one night. tried 2 more nights, same as before. return policy as presented in store is deceptive. charged me again to pickup mattress. they will not take back adjustable frame. after return, net out of pocket, is $3k.


I have tried to cancel the Select Comfort bed and have received nothing but problems. The 100% customer service is a joke. I would not recommend Select Comfort. You better read all the fine print because if you are not happy they charge you 25% to ship back a crappy product even after you tell them it is junk. They also charge you for shipping back to them . They only want you to sign or say yes and once they get your credit a Approved you are screw they promis you the world and you can only send back the mattress they are not a good company junk product and fast talkers . They do thing not legal in many states but push the limit and get away with it. Crappy company we lost our job do to COVID and they would not let us return a product we have not received for full refund which is illegal in most states. They know what they are doing and sell junk do not buy select comfort .

I inherited a sleep number bed that was purchased in 2003. I love it, but need to attach a headboard. The kits that are sold are for newer mattresses. Any ideas? Can I drill holes in the hard plastic base? I do not want to replace the bed, but need a headboard. My understanding is that I must use the included platform rather than a different one. Thanks!


We have owned our Sleep Number bed for over 20 years. We love it! I would not buy another mattress. While we had one mattress leak, it was replaced immediately for$100 after 15 years. We had one foam area that did develop mold after more than 10 years, and it was replaced immediately without cost.


The one complaint we have is the trenching effect. We have a full size mattress (which is not big enough for us) and wanted to increase to queen, but the queen chambers are not any wider (only longer- having more foam pieces in the middle. I do not want the trenching effect any longer. We are probably moving to the king split mattresses, but with an adjustable base from another company due to cost (way too much from SN) and inability to return.


you need a degree to assemble the twin bed and i got NO help from customer service in chat. so i got help from task rabbit and they would NOT cover the cost. i could NOT get them to disassemble the mattress to return it for a refund. i thought the bed was ok once assembled, but NOT worth the money and the trouble!


We bought a King 9000 in 2007 for about $3200. I t has the power frames and does not split in the middle. We have mostly loved the bed. Because Im good at maintenance moving the bed is little easier for me. However, the pillow top went flat eventually after about 5 years maybe 4. Sleep number wanted at the time $1200 which was flipping rediculous! I unzipped and removed the pillow top and we again enjoyed the bed with a Walmart mattres pad for a $100 which works great. We have had to replace the pump because of deflating twice. This is the third time I need a new pump and they want $350 for new 4 valve because my pump has 4 air lines. Sleep number needs to sell replacement parts for the internal pump parts. I had to move the bed and it started leaking. This time I took apart the pump and sprayed the airlines with soapy water to discover it was a loose hose clamp. While trying to get the air line off the plastic part broke off. They only sell the entire pump sadly. They are a pain in the caboose if you need to move the bed. For the money the pump should be of higher quality. We do love the bed and I would own another one.
